Terms of Service

These terms govern use of EVolve, a service provided by AskEV LLC, an Illinois limited liability company. By using EVolve you agree to them. Where AskEV has signed a separate written agreement with your employer, that agreement controls and these terms fill the gaps.

1. What EVolve does

EVolve collects ideas from a company's employees about where AI could help, uses an AI assistant to shape those ideas and interview the submitter about their likely return, and ranks the results so the company can decide what to build. It is a decision support tool. It does not implement anything.

2. Accounts

Accounts are created by your employer's administrator, not by self-signup. You log in with a one-time code sent to your work email, so keep access to that mailbox secure. You are responsible for activity under your account. Tell your administrator immediately if you think someone else has access to it.

3. Acceptable use

You agree not to:

  • submit anything unlawful, harassing, or infringing of someone else's rights;
  • submit confidential information belonging to a third party that you are not permitted to share;
  • attempt to access another company's data, or probe or disrupt the service;
  • use the AI assistant to generate content unrelated to your employer's business.

4. Your content

Ideas, descriptions and interview answers submitted through EVolve belong to your employer, in line with the ordinary rules of your employment. AskEV claims no ownership of them. AskEV is granted only the licence needed to operate the service: to store the content, process it through the AI provider to produce assessments, and display it back to authorised users at your company.

AskEV may use aggregated, de-identified statistics about how the service is used to improve it. This never includes the text of your ideas or conversations, and never identifies you or your employer.

5. AI output, and its limits

The assistant and the ROI assessment are generated by an AI model. AI output can be wrong, and sometimes confidently wrong. Every financial figure EVolve produces is an estimate derived from answers a person typed into an interview. It is not an appraisal, not an audit, and not financial, legal, or tax advice.

Do not make an investment or staffing decision on an EVolve number without checking it. The figures are there to rank options against each other and to make the assumptions visible, and the assumptions behind every score are shown alongside it precisely so they can be challenged.

6. Availability

EVolve is provided on an “as available” basis. There is no uptime commitment in these terms. Maintenance, upgrades and occasional outages should be expected. Where a signed agreement with your employer promises a service level, that promise governs.

7. Trials and suspension

Companies may be given a trial period. When a trial ends, the ranked roadmap and business case remain readable and exportable, while new idea submissions and new AI assessments pause. AskEV may suspend an account that is being used in breach of section 3, or where doing so is necessary to protect the service or another customer.

8. Privacy

What EVolve stores and how to have it deleted is set out in the Privacy Policy, which forms part of these terms.

9. Disclaimers and liability

To the fullest extent the law allows, EVolve is provided without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. AskEV does not warrant that the service will be uninterrupted or error free, or that AI output will be accurate.

To the fullest extent the law allows, AskEV is not liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, lost revenue, or lost data. Where your employer has a signed agreement with AskEV, the limitation of liability in that agreement applies and takes precedence over this section. Nothing here limits liability that cannot be limited by law.

10. Termination

Your employer may close its account at any time, and you may stop using EVolve at any time. When a company account is closed, its data is deleted as described in the Privacy Policy.

11. Governing law

These terms are governed by the laws of the State of Illinois, without regard to its conflict of laws rules. The courts of Cook County, Illinois have exclusive jurisdiction, except where a signed agreement with your employer says otherwise.

12. Changes

These terms may be updated. Material changes will be notified to company administrators and the date at the top will change. Continuing to use EVolve after a change means you accept it.
